Who Owns a Type-In Program Forty Years Later?

Forty years after readers painstakingly typed programs from the pages of computer magazines, those listings live again in scans and digital archives. But does preservation bring permission with it, and who might still own the code? This hypothetical exploration follows the surprisingly tangled trail from printed page to modern emulator.

There is a particular kind of intimacy in a type-in program. As we saw while looking back at Softside Magazine from August 1983, these programs were once simply part of the experience of reading a computer magazine. You did not merely receive the software. You assembled it, line by line, often with one eye on the listing and one on the machine, hoping a stray keystroke would not turn the whole exercise into a lesson in humility.

But consider what happened when the final RUN was entered and the program actually worked. The magazine belonged to you. The copy of the program in your computer had been typed by you. The original program had been written by somebody else. And somewhere behind all of this was a magazine publisher who had acquired the program for publication. Forty years later, when many of those magazines survive as scans and their programs can be running in an emulator within minutes, the simple question of who owns what becomes surprisingly interesting.

You typed it, but did you own it?

On the page, the arrangement seemed wonderfully straightforward. A magazine printed a BASIC listing, the reader typed it in, and out came a utility, game, demo or lesson. It was software distribution conducted through ink, paper and human fingers.

Yet several different things were travelling together. There was the physical magazine, the printed listing, the program represented by that listing, and eventually the copy painstakingly entered into the reader's computer. They felt like parts of the same object because the magazine deliberately presented them that way. Copyright makes the picture more curious: ownership of the magazine, ownership of the issue as a publication, and ownership of the program itself need not have belonged to the same person.

That distinction was probably of little concern to the teenager spending Saturday afternoon finding the mistyped character somewhere around line 1840. The whole point of publishing the listing was that the reader was expected to type it. Once it finally worked, it was entirely natural to think of the program on the screen as yours. You had, after all, just spent two hours building it.

A peculiar way to distribute software

Type-ins make more sense if we stop thinking of them simply as magazine articles. They were also a distribution technology.

Today we download software. In the 1980s it might arrive on cassette, floppy disk or cartridge. But a magazine could transport software using nothing more exotic than printed characters. The reader supplied the decoding mechanism: eyes, fingers, keyboard and patience. A few pages of BASIC could cross a country without a single disk changing hands.

That creates a wonderfully strange object. The author had written a program. The publisher had printed it. The reader had reconstructed it. All three had participated in getting the software onto the machine, but participation did not necessarily mean ownership.

Nor did publication necessarily mean that the program had been released without restriction. Some publishers acquired rights from contributors, some commissioned material, and arrangements varied between publications and periods. A magazine was giving readers an obvious invitation to type in and enjoy the program, but that is quite different from declaring that anybody could thereafter republish it, sell it, place it in another collection or treat it as public-domain software.

Now add forty years

This is where the thought experiment becomes much more interesting.

Imagine finding a 1984 computer magazine online. It contains a small BASIC space game. The magazine has been scanned beautifully. The author's name appears above the listing. Perhaps there is even a screenshot showing what the game should look like.

You type the listing into an emulator and it runs.

What exactly have you created?

You have not physically copied somebody's forty-year-old floppy disk. You have read characters from a historical document and entered them into a modern recreation of an old computer. Nevertheless, the program running inside the emulator is recognisably the program that somebody else wrote in 1984.

Now save it as a file. Correct two obvious printing errors. Add a comment identifying the magazine. Upload it for other enthusiasts so they do not have to type the whole thing themselves.

At what point did historical preservation become republication?

There may not be a simple answer without knowing considerably more about the original program and the arrangements under which it was published. That uncertainty is precisely what makes old type-ins so fascinating.

The answer may be sitting in a filing cabinet

If we genuinely wanted to establish who controlled our imaginary 1984 space game, the most interesting evidence might not be the program at all. It might be paperwork that nobody thought worth preserving.

Those questions can lead to very different answers. Yet the contract, submission form, correspondence or contributor agreement that answered them may have disappeared decades ago.

The magazine survives. The listing survives. The program survives. The paperwork explaining their relationship may not.

That is a delightful reversal of what we normally think of as software preservation. We worry about deteriorating disks and obsolete file formats, yet sometimes the BASIC listing is the easy thing to preserve. The fragile component is the mundane administrative record explaining what everyone agreed to do with it.

A scan preserves more than it settles

Digital archives have made this puzzle visible on a scale that would have been difficult to imagine when these magazines were new. A publication that once disappeared into cupboards, garages and recycling bins can now be available around the world as a high-resolution scan.

That is an extraordinary achievement. But a scan answers a preservation question more readily than it answers an ownership question.

The scan can show us exactly what appeared on page 63. It can preserve the typography, advertisements, editorial notes and BASIC listing. It can tell us who was credited. It may even reveal a copyright notice or contributor statement. What it cannot necessarily tell us is everything that happened before the page went to press.

This is why old software can occupy such a peculiar cultural space. Something can be visible everywhere without being obviously free to reuse. It can be historically important without having a readily identifiable owner. It can be easy to emulate while its provenance remains difficult to reconstruct.

Age itself does not resolve those questions. Forty years can make the hardware obsolete, the magazine collectible and the program historically interesting while leaving surprisingly complicated questions about the work behind it.

The program has several afterlives

A type-in program can now survive in forms its original author probably never contemplated. There is the magazine sitting on a collector's shelf. There is the scanned page in a digital archive. There may be a floppy disk created by a reader in 1985. Someone else may have transcribed the listing into a text file. Another enthusiast may have corrected it. And today the program might run inside an emulator on a computer thousands of times more powerful than the machine for which it was written.

They can all contain essentially the same little program.

Yet culturally they are quite different objects. One is an artefact, another a reproduction, another a reader's working copy, another a modern transcription. Copyright adds another layer to those distinctions, but the more interesting observation is that digital objects can outlive the circumstances that originally explained how they were supposed to circulate.

The rights are not stored in the disk image. Neither is the story of how the program got there.

What survives is narrower than memory

So who owns a type-in program forty years later?

Sometimes the answer may be straightforward. The original author may still hold the rights. A publisher may have acquired them. The program may genuinely have been released for unrestricted sharing. In other cases, establishing the answer could require reconstructing agreements made when a few pages of BASIC were considered disposable magazine material rather than something people would still be running four decades later.

And perhaps that is the most interesting thing about the question. Printed software was never just text. It was software travelling inside an editorial medium. The magazine delivered the instructions, while the reader supplied the machinery that turned those instructions back into a program.

Today we can preserve the magazine, extract the listing, type it into an emulator and watch the program come alive again. Technically, the journey from 1984 to 2026 can be remarkably easy. The historical trail explaining who wrote it, what the publisher acquired and what later readers were entitled to do with it can be much harder to reconstruct.

There was, however, another side to early software culture: programs deliberately distributed so that people could copy, explore and share them. That leads into a rather different story.
